Terms of service
These terms are the agreement between you and us about using Take 5 Live. Using the app, the website or the dashboard means you accept them.
Version 1.0. In effect from 20 August 2026.
1. Who these terms are with
Take 5 Live is operated by Jared Neaves (ABN 32 623 644 883), a sole trader in Australia. In these terms "we", "us" and "our" mean that business, and "you" means the person or the organisation using the service.
Where an organisation subscribes, the person who accepts these terms confirms they are authorised to bind that organisation, and the organisation is responsible for everyone it invites to its team.
2. What the service is, and what it is not
Take 5 Live records safety inspections. It gives a worker a checklist or a Take 5 assessment to complete, captures their answers, notes, photographs and signature, produces a PDF, and where a team account exists uploads that record so supervisors can see it.
It is a recording tool, not a compliance authority
Take 5 Live does not certify, approve, audit or verify anything. It does not determine whether equipment is safe to operate, whether a task should proceed, whether an inspection was carried out honestly or competently, or whether you meet any obligation under work health and safety law.
It records what a person entered. That is all it does, and everything it produces should be read that way. A record marked PASS means somebody answered yes to a list of questions. It does not mean the machine is safe.
Your duties under the work health and safety laws of your state or territory, and under any standard, code of practice or site procedure that applies to you, remain entirely yours. Using this product does not reduce, transfer or discharge them, and no part of the service should be treated as legal, engineering or safety advice.
Templates are starting points
The app ships with built-in templates for light vehicles, trucks, underground loaders and integrated tool carriers, and the Take 5 assessment itself.
These are drawn from common industry practice. They are not a standard, they are not endorsed by any regulator, and they are not tailored to your site. They exist so that a crew can start on day one instead of staring at an empty screen.
Before anyone relies on a template you must review it against your own plant, your own risk assessments and your own site requirements, and change it. The app lets you edit any template or write your own precisely so that you can. If you use a supplied template unchanged, that is your decision and its adequacy is your responsibility.
3. Accounts
- You must give an accurate email address and keep it current, because it is how you sign in and how we reach you.
- Sign-in links are single-use and expire. Do not forward one; anybody holding it can sign in as you until it is used or expires.
- You are responsible for what happens under your account. Tell us promptly if you think it has been accessed by somebody else.
- A team owner is responsible for who they invite and for removing people who leave. Removing a member also cuts off the phones enrolled to them.
- You must be at least 16, and using the service in a work context.
4. Plans, trials and payment
The free tier
The app is free for one person, with no account, no expiry and no reduced functionality. We may change what the free tier includes in future, but we will not start charging for something you are already relying on without notice, and records already on a device are never taken away.
Trials
Paid plans start with a 14-day trial with no card required. At the end of the trial the paid features stop unless a subscription is started. Nothing recorded during the trial is deleted because of it.
Subscriptions
- Subscriptions are sold from this website and billed through Stripe. They renew automatically, monthly or yearly, until cancelled.
- Prices are in Australian dollars (AUD) and are the whole amount payable. Current prices are on the pricing page.
- No GST is charged, because the business is not registered for GST. The document Stripe issues is an invoice and not a tax invoice. Our ABN appears on it, so no withholding obligation arises for you.
- Plans are limited by the number of people in the team. If you need more seats than your plan allows, change plan.
- We may change prices with at least 30 days' notice by email. A change takes effect at your next renewal, never mid-term, and you can cancel before it applies.
If a payment fails
We will retry and email you. If it stays unpaid the paid features are suspended, not deleted. See section 5.
5. What happens when a subscription ends
This is the clause worth reading twice, because it is a promise about your safety records.
- The app keeps working. Workers can still complete a Take 5 or a pre-start, sign it, and save the PDF to the phone. A safety tool that stops working because an invoice was missed is a safety tool nobody should risk, so we do not build one.
- Uploads stop, and the supervisor dashboard stops.
- Nothing already recorded is deleted or hidden. Your records remain, and resubscribing restores access to them.
- You can ask us to export your records at any time while the account exists, including after it lapses. We will provide them in the formats the service already produces, which are PDF and JSON.
- If an account stays closed we may delete its data 60 days after closure. We will email the owner before that happens.
6. Cancelling
Cancel at any time from the billing page, which opens Stripe's billing portal. Access continues to the end of the period you have already paid for, and it does not renew.
We do not give partial refunds for time already paid for, and we do not require a reason, a notice period or a phone call to cancel. If something has gone wrong on our side, or you have been charged for something you did not intend, email us and we will sort it out. Nothing here limits your rights under the Australian Consumer Law.
7. Acceptable use
You must not:
- Use the service unlawfully, or to breach a work health and safety duty.
- Falsify a record. Recording an inspection that was not carried out, or signing as somebody else, may be an offence and is grounds for us to terminate the account immediately.
- Try to reach another customer's data, probe or bypass access controls, or test the security of the service without our written permission.
- Upload malware, or content that is unlawful, defamatory or grossly offensive.
- Upload personal information you have no right to hold, including sensitive information about a person who has not agreed to it being recorded.
- Resell or white-label the service without a written agreement.
- Scrape it, or place automated load on it beyond ordinary use.
- Share one account between people to avoid paying for seats.
If you find a security flaw, tell us at security@take5live.com.au and give us a reasonable chance to fix it. We will not pursue anyone who reports a genuine flaw responsibly and does not access other people's data in the process.
8. Your data
- Your records are yours. We claim no ownership of anything you put into the service.
- You grant us only the permission we need to run the service: to store your records, move them between our systems, back them up, and show them to the people in your team who are entitled to see them.
- We do not use your records to train machine learning models, we do not analyse them across customers, and we do not sell them.
- You are responsible for having the right to record information about your workers, and for telling them that their records are uploaded and who can see them. The privacy policy is written so you can point them at it.
- Handling of personal information is covered by the privacy policy, which forms part of these terms.
9. Availability
We aim to keep the service running and we do not offer a service level agreement or an uptime guarantee. We are one person, and pretending otherwise would be a promise we cannot keep.
What we can promise is the part that matters on site: the app does not need us to be up. It works entirely offline, saves every record to the device, and queues uploads until the service is reachable again. An outage delays the dashboard, it does not stop an inspection.
We may take the service down for maintenance, and will give notice where we can.
10. Our liability
Written plainly, because a limitation nobody can read protects nobody.
Rights that cannot be excluded
Our goods and services come with guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these terms limits those rights. If we fail to meet a consumer guarantee, you may be entitled to a remedy under that law, and where the law allows us to limit our liability for a failure we limit it to resupplying the service or paying the cost of resupply.
Everything else
Beyond those rights, and to the extent the law permits:
- The service is provided as it is. We do not warrant that it will be uninterrupted or error free, or that a record it produces satisfies any particular legal or regulatory requirement.
- We are not liable for anything arising from a decision made on the basis of a record. If an inspection was completed carelessly or dishonestly and somebody was hurt, that is a failure of the inspection, not of the software that wrote it down. See section 2.
- We are not liable for indirect or consequential loss, lost profit, lost production, lost data beyond our reasonable control, or a fine or penalty imposed on you.
- Our total liability for all claims in any twelve month period is limited to the amount you paid us in that period. On the free tier that amount is nil, which is the honest consequence of a product given away.
You agree to indemnify us against a claim brought by a third party arising from your use of the service in breach of these terms.
11. Ending the agreement
You can stop using the service at any time and cancel as described in section 6.
We may suspend or terminate an account that breaches these terms. Except for a serious breach such as falsifying records or attacking the service, we will tell you what the problem is and give you a reasonable chance to fix it first. If we terminate an account that was not in breach, we refund the unused portion of what you paid.
On termination we will, on request within 60 days, provide an export of the account's records.
12. Changes to these terms
We may update these terms. For a material change we will email account holders at least 30 days beforehand. If you do not accept a change, cancel before it takes effect and we will refund the unused portion of the current term.
13. General
- These terms and the privacy policy are the whole agreement between us about the service.
- If a clause is unenforceable, the rest still applies.
- Not enforcing a term on one occasion does not waive it.
- You may not transfer these terms without our consent. We may transfer them if the business is sold, on notice to you.
- These terms are governed by the law of Western Australia, and the courts of Western Australia have jurisdiction. This does not deprive you of the protection of the consumer law of the place where you live.
